Draft terms, not yet in effect
This is a working version under legal review. It binds neither you nor us and may still change. Before the terms take effect, we will let you know in the app and ask you to accept them.
This is an informational translation. The binding version is the Polish terms.
JayNest Terms
Draft of 4 November 2026. It covers the JayNest app, the JayNest account, sync, the web app (app.jaynest.app) and the Pro Cloud subscription.
1. Who provides the service
- JayNest services are provided by Bity i bajty uśmiechniętej Marty, [full details: name or business name, address, tax number (NIP), possibly REGON or CEIDG entry], hereinafter “we”.
- Contact: [email protected]. This address is also the point of contact for users and authorities under the Digital Services Act (DSA). We reply in Polish and English.
- The terms are available free of charge at jaynest.app/en/regulamin, also in the app, in a form that can be downloaded, saved and printed.
2. Definitions
- App: the JayNest app for phones or tablets, downloaded from an app store (the App Store, later Google Play).
- Web App: JayNest in the browser at app.jaynest.app.
- Catalog: everything you enter in JayNest: rooms, containers, items, photos, dates, prices, tags and other data.
- Account: a JayNest account, created with an email and password or with Apple or Google.
- Pro Local: a one-time purchase in the App that removes the item limit on the device.
- Pro Cloud: a subscription with an Account, sync, a copy of the Catalog on our server and the Web App.
- Consumer: a natural person using JayNest for purposes not directly related to their business or profession. We also apply the consumer rules to a sole trader when the contract is not professional in nature for them.
3. What we offer
- The App without an account is free. The Catalog then stays only on the device, and we neither see nor store it. The free version allows up to 37 items (rooms, containers and things in the Trash don't count).
- Pro Local removes this limit on devices with the same app store account (Apple ID or Google account). A purchase in the App Store doesn't work on Android and vice versa.
- Account and Pro Cloud: syncing the Catalog across devices, a copy of the Catalog and photos on our server, the Web App, a 30-day Trash and change history. Pro Cloud has tiers by number of items (1,000, 2,000 and more) and works on all devices of the Account, regardless of where it was bought.
- The Pro Cloud free trial lasts one month and is available once per Account.
- The current scope of features is described in the App and on jaynest.app. Features marked as test features may change.
- You print QR labels yourself. A label contains a link to jaynest.app that opens the App. The link alone gives no one access to your Catalog.
4. Technical requirements
- App: an iPhone or iPad with iOS or iPadOS 18 or later and, once the Android version is available, a phone or tablet with a supported Android version listed in Google Play.
- Account and sync: internet access and an email address or an Apple or Google account.
- Web App: a computer or tablet with an up-to-date browser (Safari, Chrome, Firefox, Edge) with JavaScript and the cookies needed for signing in enabled.
5. Account
- An Account may be created by a person aged at least [16 / 18]. [For the lawyer to decide: minors with the consent of a legal guardian.]
- The contract for keeping an Account is concluded when it is created, for an indefinite period, and is free of charge. Only the Pro Cloud subscription after the free trial is paid.
- You keep your password confidential. If you suspect someone knows your password, change it and sign out other devices, or write to us.
- You can delete the Account at any time in the App (Settings, JayNest Account) and, once this feature is available, also in the Web App. Deleting the Account ends the contract and immediately removes the Account and the Catalog from our server. The data on your devices stays. A subscription in an app store must be cancelled separately in that store.
6. Rules of use
- The Catalog is private: only you and the people you share it with, once such a feature is available, can see it.
- JayNest may not be used to store or distribute illegal content, to infringe the rights of others or for activities that disrupt the service (e.g. automated load on the server).
- You are responsible for the data you enter, including data about other people (e.g. who something was lent to). Enter it only as far as needed to keep the Catalog.
- The rights to your photos and descriptions remain yours. You only grant us a non-exclusive, free permission to store them, transfer them between your devices and display them to you, as far as needed to provide the service and for as long as it lasts.
- Illegal content can be reported to [email protected]. We will handle the report without undue delay and inform the reporting person and the Account owner of the decision, with reasons.
- In the event of a serious breach of these rules, we may block the Account after first asking for the breach to stop, unless the breach is gross or the law requires otherwise. Blocking doesn't remove data from devices.
7. Payments and subscription
- You buy Pro Local and Pro Cloud in the App through the app store (the App Store, later Google Play). Payment, tax settlement and renewal are then handled by the store under its own rules. Prices are shown in the store before purchase.
- Pro Cloud renews automatically for another period (a month or a year) until you cancel it in the store where it was bought. Cancellation takes effect at the end of the paid period.
- Changing the Pro Cloud tier is done in the store. Moving to a lower tier removes nothing. When there are more items than the limit, they can be viewed, edited, moved and deleted, but no new ones can be added.
- After Pro Cloud or the free trial ends, the Catalog on the server is read-only for 30 days. 10 days before deletion, we send a reminder to the Account's address. After 30 days, we delete the Catalog and photos from the server. The Account and the data on devices stay.
- [When Pro Cloud sales through the website start: payment operator, invoices, how to cancel. To be completed.]
8. Withdrawal from the contract
- Purchases in the App Store and Google Play: refunds and withdrawal are handled by the store where the purchase was made, under its own rules and consumer law.
- [Purchases through the website: the Consumer's right to withdraw from the contract within 14 days, the model statement and the effects of starting the service before that period ends. To be prepared by the lawyer before web sales start.]
9. Complaints and conformity of the service with the contract
- We are responsible for the service's conformity with the contract under the Polish Consumer Rights Act (the chapter on digital content and services) and the Civil Code.
- Send a complaint to [email protected] from the Account's address. Describe what doesn't work and since when. We will reply within 14 days.
- If the service doesn't conform with the contract, we will bring it into conformity. The Consumer also has the rights provided by law, including a price reduction or withdrawal from the contract.
- Complaints about purchases in an app store (payments, refunds) are made in that store.
10. Service availability and liability
- We make sure the service works without interruptions, but technical breaks may happen (e.g. updates). We announce longer planned breaks in advance when possible.
- We make daily, encrypted database backups. Even so, we recommend keeping important documents (e.g. receipts and warranty cards) outside JayNest as well.
- We are not liable for the effects of interruptions and errors caused by factors beyond our control, including the actions of app stores, internet providers and force majeure.
- Towards Consumers, limitations of liability apply only as far as the law allows. They don't exclude the Consumer's statutory rights.
11. Personal data
The rules for processing data are described in the privacy policy. We process Account data because it is needed to perform the contract, so we don't ask for separate consent. We don't send ads or a newsletter.
12. Changes to the terms
- We may change the terms for important reasons: changes in the law, decisions of authorities, changes in the scope or way the services are provided, new features, security reasons.
- We announce a change at least 14 days before it takes effect, by email to the Account's address and in the App.
- If you don't accept the changes, you can delete the Account before the day they take effect. Changes don't affect rights acquired before they take effect, including a paid Pro Cloud period.
13. Termination of the contract
- You can terminate the contract at any time by deleting the Account.
- We may terminate the contract for important reasons (e.g. ending the service) with 30 days' notice, informing you by email. For an unused, paid Pro Cloud period, we refund a proportional part of the fee or arrange a refund through the app store.
- In the event of a gross breach of the terms, we may terminate the contract with immediate effect.
14. Final provisions
- The contract is governed by Polish law. For a Consumer from another country, this doesn't remove the protection given by the mandatory provisions of their country.
- Disputes with Consumers are settled by the courts with jurisdiction under general rules. A Consumer may also use out-of-court dispute resolution, e.g. the help of a municipal or district consumer ombudsman or the provincial Trade Inspection in Poland.
- The terms apply from [date]. Previous versions are available on request.
